Who we are
Existantly is a business name of Dark Marketing LLC, a California limited liability company based in San Diego, California ("Existantly", "we", "us"). This policy covers existantly.com, our customer app at mx.app.existantly.com, and the services we provide to business customers. Effective date: October 16, 2026.
Information we collect
Depending on how you interact with us, we collect these categories of personal information:
- Identifiers, such as your name, email address, phone number and IP address.
- Professional information, such as your job title and the company you work for.
- Commercial information, such as the services you buy from us and your billing records.
- Internet activity, such as the pages you visit on our site, your browser and device type, and the date and time of your visit.
- General location, such as the city or country inferred from your IP address.
- The content of messages you send us, such as chat messages, emails and form entries.
Where we get it
- From you, when you fill out a form, book a call, chat with us, sign up or email us.
- Automatically, from your browser or device when you visit our site or use the customer app.
- From our customers, when they give us information about the companies and contacts they want to reach.
- From commercially available business data providers and public sources, such as company websites and professional networking profiles.
How we use information
- To respond to your questions and requests, and to schedule and hold calls with you.
- To provide, run, support and improve our services and our website.
- To run outbound campaigns for our customers, as described below.
- To send you information about our services. You can opt out at any time.
- To bill customers, keep accounts secure and prevent fraud.
- To meet legal obligations and enforce our agreements.
Business contact data we handle for customers
Our services include running outbound email and calling campaigns for business customers. To do that, we use business contact information, such as a person's name, job title, company, work email and work phone number, to reach companies our customers want to do business with. We use this information to deliver services under our agreements with customers.
If you received an outreach email or call from us or on behalf of one of our customers and do not want to be contacted, reply to the email, ask the caller, or write to support@existantly.com. We will add you to our do-not-contact list.
How we share information
We disclose personal information only to these categories of recipients:
- Service providers that help us run our business, such as website hosting, database, live chat, scheduling, email sending, calling and payment providers. They may use the information only to provide services to us.
- Our customers, when the information relates to work we do for that customer, such as a meeting booked for them.
- Government authorities or other parties, when required by law, or to protect the rights, property or safety of Existantly, our customers or others.
- A buyer or successor, as part of a merger, acquisition or sale of all or part of our business.
No sale or sharing of personal information
We do not sell personal information, and we do not share it for cross-context behavioral advertising. We have not done either in the past 12 months. We do not knowingly sell or share the personal information of anyone under 16. We do not use or disclose sensitive personal information for any purpose that would require us to offer a right to limit its use.
We do not disclose personal information to third parties for their own direct marketing purposes.
Cookies and tracking
We use cookies that our site and the customer app need to work, such as keeping you signed in. We do not use third-party advertising cookies or advertising tracking on our site. Our live chat provider may set its own cookies to run the chat window.
Because we do not track you across other websites, our site does not change its behavior in response to browser "Do Not Track" signals. We treat a Global Privacy Control signal as a request to opt out of the sale or sharing of your personal information.
How long we keep information
We keep personal information only as long as we need it for the purposes in this policy, to provide our services, and to meet legal, tax, accounting and reporting obligations. Business contact data used for outreach is kept while it is relevant to active customer campaigns. Do-not-contact requests are kept so we can continue to honor them. When we no longer need information, we delete it or make it anonymous.
How we protect information
We use reasonable technical and organizational safeguards to protect information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
Your privacy rights
You can ask us to opt you out of marketing emails at any time, and to review or correct the information we hold about you.
If you are a California resident, you also have the right to: know what personal information we have collected about you, where it came from, why we collected it and who we disclosed it to; get a copy of it; ask us to delete it; ask us to correct it; and opt out of the sale or sharing of it. We will not discriminate against you for using these rights.
To make a request, email support@existantly.com or call us toll free at +1 (877) 400-5577. We will confirm your identity by matching the information you give us with information we hold, before we act. You can use an authorized agent to make a request for you. We may ask the agent for proof that you authorized them, and may ask you to confirm your identity directly. We respond within 45 days. If we need more time, up to 45 more days, we will tell you why.
Residents of other states may have similar rights under their state laws. Contact us the same way to make a request.
Children
Our website and services are for businesses. They are not directed to children, and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us personal information, contact us and we will delete it.
Changes to this policy
We review this policy at least once a year. When we make changes, we update the "Last updated" date at the top of this page. If we make material changes, we will post a notice on this page, and we will email customers whose information is affected.
